DMCA & Copyright Policy
1. Commitment to Copyright Protection
LISA Film GmbH ("CZWTV," "we," "us," or "our"), the operator of the streaming platform available at CZWTV.com, is firmly committed to protecting intellectual property rights and respecting the creative works of content owners worldwide. We take copyright infringement extremely seriously and will respond expeditiously to any notices of alleged infringement that comply with applicable law.
All content available on the CZWTV platform — including, without limitation, films, television series, live TV broadcasts, original programming, trailers, promotional materials, graphics, logos, trademarks, user-interface designs, software code, and all associated metadata — is either owned by or exclusively licensed to LISA Film GmbH. This content is protected under international copyright law, trademark law, and other applicable intellectual property statutes. Any unauthorised reproduction, distribution, public performance, communication to the public, or making available of such content, in whole or in part, constitutes a violation of applicable law and may result in civil liability and criminal penalties.
CZWTV maintains robust policies and technological measures to prevent, detect, and respond to copyright infringement both on our platform and on third-party platforms where our content may appear without authorisation.
2. Legal Framework
CZWTV's copyright protection policies and enforcement activities are grounded in, and comply with, the following legal instruments:
- United States Digital Millennium Copyright Act (DMCA) — 17 U.S.C. § 512 et seq., which establishes a framework for online service providers to address copyright infringement, including safe harbour provisions, notice-and-takedown procedures, and counter-notification rights.
- EU Directive 2001/29/EC — Directive on the harmonisation of certain aspects of copyright and related rights in the information society (the "InfoSoc" Directive), which harmonises the rights of reproduction, communication to the public, and distribution across EU member states.
- EU Directive (EU) 2019/790 — Directive on copyright and related rights in the Digital Single Market (the "DSM Directive"), which introduces, among other provisions, obligations for online content-sharing service providers regarding the use of protected content.
- Austrian Copyright Act (Urheberrechtsgesetz – UrhG) — The principal Austrian statute governing the protection of literary and artistic works, related rights, and enforcement mechanisms, as amended.
- Berne Convention for the Protection of Literary and Artistic Works — The foundational international treaty ensuring mutual recognition of copyright across its 181 contracting states, establishing minimum standards of protection and the principle of national treatment.
- WIPO Copyright Treaty (WCT) — An international treaty administered by the World Intellectual Property Organization that supplements the Berne Convention and extends copyright protection to the digital environment, including the right of making available and obligations concerning technological protection measures.
- WIPO Performances and Phonograms Treaty (WPPT) — An international treaty providing performers and producers of phonograms with economic and moral rights in the digital environment, including rights of reproduction, distribution, rental, and making available.
CZWTV reserves the right to invoke any and all remedies available under these and other applicable laws in order to protect its intellectual property and the intellectual property of its licensors.
3. Designated DMCA Agent
In accordance with 17 U.S.C. § 512(c)(2), CZWTV has designated the following agent to receive notifications of claimed copyright infringement:
DMCA Designated Agent: Andrea Hroch
Organisation: CZWTV Media Services
Mailing Address: Seecorso 4, 9220 Velden am Wörther See, Austria
Email: [email protected]
All DMCA takedown notices and counter-notifications should be directed to the designated agent at the contact information provided above. Notices sent to other addresses or departments may not receive a timely response.
4. Reporting Copyright Infringement (Takedown Notices)
If you believe that your copyrighted work has been copied, reproduced, or made available on the CZWTV platform or elsewhere in a manner that constitutes copyright infringement, you may submit a written notification to our designated DMCA agent. To be effective under 17 U.S.C. § 512(c)(3), your notification must be a written communication that includes substantially the following:
Required Elements of a Takedown Notice
- Physical or Electronic Signature. A physical or electronic signature of a person authorised to act on behalf of the owner of the exclusive right that is allegedly infringed.
- Identification of the Copyrighted Work. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site. Please provide sufficient detail to enable identification, such as the title, registration number (if applicable), and a description of the work.
- Identification of the Infringing Material. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit CZWTV to locate the material. Providing the specific URL(s) where the allegedly infringing content is located is the most effective way to identify the material.
- Contact Information of the Complainant. Information reasonably sufficient to permit CZWTV to contact the complaining party, including your full legal name, mailing address, telephone number, and email address.
- Good Faith Statement. A statement that you have a good faith belief that use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.
- Statement of Accuracy Under Penalty of Perjury. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorised to act on behalf of the owner of an exclusive right that is allegedly infringed.
Important: Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys' fees. Please ensure that you have a good faith basis for your claim before submitting a notification.
Upon receipt of a valid takedown notice, CZWTV will act expeditiously to remove or disable access to the allegedly infringing material and will take reasonable steps to notify the alleged infringer that it has done so.
5. Counter-Notification Procedure
If you believe that content you posted on the CZWTV platform was removed or disabled as a result of a mistake or misidentification, you may submit a written counter-notification to our designated DMCA agent in accordance with 17 U.S.C. § 512(g). Your counter- notification must include substantially the following:
- Physical or Electronic Signature. Your physical or electronic signature.
- Identification of Removed Material. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled (e.g., the specific URL).
- Statement Under Penalty of Perjury. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Consent to Jurisdiction and Contact Information. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if your address is outside of the United States, any judicial district in which CZWTV may be found), and that you will accept service of process from the person who provided the original infringement notification or an agent of such person.
Upon receipt of a valid counter-notification, CZWTV will promptly provide the person who filed the original takedown notice with a copy of the counter-notification and inform that person that the removed material will be restored or access re-enabled in ten (10) to fourteen (14) business days. If the original complainant does not file a court action seeking a restraining order against the subscriber within that period, CZWTV will restore the removed material or re-enable access to it.
6. Repeat Infringer Policy
In accordance with 17 U.S.C. § 512(i) and our commitment to copyright protection, CZWTV has adopted and reasonably implemented a policy that provides for the termination, in appropriate circumstances, of the accounts of users who are repeat infringers.
CZWTV will, at its sole discretion, disable access to or remove content posted by users who have been identified as repeat infringers. A "repeat infringer" is any user against whom CZWTV has received more than two (2) valid DMCA takedown notices or who has otherwise been determined by CZWTV to have repeatedly engaged in infringing activity. CZWTV reserves the right to terminate the account of any user after a single instance of infringement where circumstances warrant, including but not limited to cases of wilful or commercial-scale infringement.
This policy is applied consistently and without exception. CZWTV maintains records of all takedown notices received and actions taken in order to identify repeat infringers and enforce this policy effectively.
7. Content Protection Measures
CZWTV employs a comprehensive suite of technical and organisational measures to protect copyrighted content on its platform and to detect and prevent unauthorised use of its content on third-party platforms. These measures include, but are not limited to, the following:
Digital Rights Management (DRM)
All content streamed through the CZWTV platform is protected by industry-standard digital rights management technologies. DRM ensures that content can only be accessed and viewed through authorised devices and applications, preventing unauthorised copying, recording, redistribution, or circumvention of access controls. Any attempt to circumvent, disable, or interfere with these DRM protections is strictly prohibited and may violate the DMCA's anti-circumvention provisions (17 U.S.C. § 1201), the InfoSoc Directive (Article 6), and the Austrian Copyright Act.
Automated Content Recognition and Monitoring
CZWTV utilises automated content recognition systems, including audio and video fingerprinting technologies, to detect unauthorised copies of its content across the internet. These systems continuously scan major video hosting platforms, social media networks, and file-sharing services for content that matches CZWTV's proprietary catalogue.
Watermarking
CZWTV may embed invisible forensic watermarks into its content streams. These watermarks enable CZWTV to trace the source of unauthorised copies back to specific accounts, sessions, or distribution channels, thereby facilitating identification and enforcement against infringers.
Third-Party Platform Monitoring
CZWTV regularly monitors third-party platforms — including, but not limited to, YouTube, Dailymotion, Facebook, Instagram, TikTok, Telegram, and various torrent and file-hosting services — for unauthorised uploads, streams, or distributions of its content. When infringing content is identified, CZWTV takes immediate action through the appropriate takedown and reporting mechanisms provided by each platform.
Partnership with Content Protection Services
CZWTV partners with specialised content protection and anti-piracy service providers to augment its monitoring and enforcement capabilities. These partners assist with large-scale detection of infringing content, automated submission of takedown requests, and forensic investigation of piracy networks.
8. Enforcement Actions
CZWTV actively monitors third-party platforms and the broader internet for unauthorised use of its content. When infringement is identified, CZWTV will take all appropriate measures to protect its rights, including but not limited to the following:
- DMCA Takedown Notices. CZWTV will submit formal DMCA takedown notices to hosting providers, video platforms, search engines, social media networks, and any other service providers hosting or indexing infringing content, requesting the immediate removal of or disabling of access to such content.
- Cease-and-Desist Letters. CZWTV will issue formal cease-and-desist letters to individuals and entities engaged in the unauthorised reproduction, distribution, or public communication of its content, demanding the immediate cessation of all infringing activity.
- Legal Action. CZWTV reserves the right to initiate civil litigation against any individual, entity, or organisation that engages in wilful or commercial-scale copyright infringement of its content. This includes seeking injunctive relief, actual or statutory damages, disgorgement of profits, and recovery of attorneys' fees and costs.
- Statutory Damages. Where available under applicable law — including 17 U.S.C. § 504(c) and the Austrian Copyright Act — CZWTV will seek maximum statutory damages for each work infringed, particularly in cases of wilful infringement.
- Referral to Law Enforcement. In cases where criminal copyright infringement is suspected — including organised piracy operations, commercial-scale distribution of infringing content, or circumvention of technological protection measures — CZWTV will cooperate with and refer the matter to the appropriate law enforcement authorities, including but not limited to Austrian federal prosecutors, Europol, and the U.S. Department of Justice.
CZWTV does not tolerate copyright infringement in any form and will pursue all available legal remedies to the fullest extent permitted by law.
